1. Scope of Application
These General Terms and Conditions (GTC) apply to the use of this website as well as the business relationship between "Renée Imesch – Wildkrautzauber" and customers (both natural and legal persons). They are applicable in the version available at the time of accessing the website or when placing an order for goods and confirming a course.
The GTC, imprint and privacy policy may be amended from time to time. "Renée Imesch – Wildkrautzauber" kindly asks customers to read these terms carefully during each visit to the website and when placing an order or confirming a course.
By using this website or placing an order or participating in a course, the customer confirms their full acceptance of these GTC including delivery and payment terms.
Should any provisions of these GTC be found to be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The operator of this website is Renée Imesch, Rebmattweg 3, 6402 Merlischachen.
2. Quality and Source of Herbs
My herbs mostly come from my own garden. As I do not have an organic certification I would like to point out that the herbs are grown without pesticides, are fresh and carefully cultivated but do not meet the strict criteria of organic certification.
In case of occasional shortages and insufficient herbs from my own garden I reserve the right to source herbs of the corresponding quality from recognised organic retailers to ensure the quality and freshness of my products.
3. Shelf Life and Storage of Natural Cosmetics
The natural cosmetics are made from carefully selected, exclusively natural ingredients – without artificial or chemical additives including preservatives. To guarantee freshness and effectiveness, the production date is indicated on each package.
The shelf life of the products is generally 6 months from the production date. I recommend storing the products in a cool, dry place to maintain their quality and effectiveness throughout the shelf life. Prolonged storage or improper storage (e.g. in direct sunlight or too warm environments) may impair the shelf life and quality of the product.
Please note that the shelf life may vary depending on the specific ingredients. For optimal use, I recommend using the product within the specified period.
Please also note that I do not assume any liability for any deterioration in quality or shelf life if the products are not stored according to the recommended conditions.
4. Information on this Website
The website "www.wildkrautzauber" contains information about products and services. Price and range changes as well as technical changes are subject to change without notice. All information on http://www.wildkrautzauber.ch (product descriptions, images, films, sizes, weights, prices, technical specifications and other details) are for guidance only and do not constitute a guarantee of properties or warranties unless explicitly stated otherwise.
Renée Imesch – Wildkrautzauber strives to provide correct, complete, up-to-date and clear information on this website; however, "Renée Imesch – Wildkrautzauber" cannot explicitly or implicitly guarantee the accuracy of this information.
I cannot guarantee that the listed products will be available at the time of order. Therefore, information about availability and delivery times is subject to change and may change at any time without notice.
5. Prices
The prices are stated in Swiss Francs (CHF).
Any shipping costs will be charged in addition, unless otherwise stated, and are to be paid by the customer. Shipping costs will be shown separately in the ordering process. Additional fees from shipping providers in Switzerland and abroad may be charged to the customer later if necessary.
Technical changes, errors and typographical mistakes are reserved. In particular, "Renée Imesch – Wildkrautzauber" reserves the right to change prices at any time without prior notice.
6. Conclusion of Contract for Product Orders
The offers on this website constitute a non-binding invitation to customers to order products and/or services from "Renée Imesch – Wildkrautzauber". By placing an order on this website and accepting these GTC the customer makes a legally binding offer to conclude a contract. "Renée Imesch – Wildkrautzauber" will then send an order confirmation by email, confirming that the customer's offer has been received. Orders placed by the customer are binding. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded (both verbally and in writing) as soon as "Renée Imesch – Wildkrautzauber" sends an acceptance declaration by email, confirming the dispatch of the ordered products or services. Orders are generally shipped within 3-7 days, provided the goods are available. If, after the conclusion of the contract, it turns out that the ordered goods cannot be delivered or not in full, "Renée Imesch – Wildkrautzauber" is entitled to withdraw from the entire contract or a part thereof. The customer will then be relieved from the obligation to pay. "Renée Imesch – Wildkrautzauber" is not obliged to provide substitute deliveries in the case of a contract dissolution.
7. Conclusion of Contract for Courses
Registration is binding and will be considered in the order of receipt. After registration, the participant will receive a written confirmation by email. The course place will be definitively reserved upon receipt of payment, which must be made no later than 7 days before the course starts.
In case of cancellation up to 7 days before the course starts, no costs will be incurred. If the cancellation occurs 4 days before the course starts, 50% of the course fee will be charged. In the case of a later cancellation or unexplained absence, the full course fee will apply. No refunds or credits will be issued in this case.
Courses will take place if a minimum of 2 participants are registered. If this number is not reached, the respective course will not take place. In this case, the course fees will be fully refunded. "Renée Imesch – Wildkrautzauber" reserves the right to cancel course dates at its discretion (e.g. due to stormy weather, illness, etc.). In this case, the costs will be fully refunded. Further claims from participants, for whatever reason, are excluded.
8. Insurance & Risk
For all courses and events organised by "Renée Imesch – Wildkrautzauber", any liability for damages of any kind is excluded. Participants are responsible for ensuring they have adequate insurance coverage. "Renée Imesch – Wildkrautzauber" cannot be held liable for theft or damage to participants' items during courses and events.
9. Payment Options and Retention of Title
The customer has access to the payment options specified during the ordering process, including bank transfer (see privacy policy), cash on site or TWINT.
"Renée Imesch – Wildkrautzauber" reserves the right to exclude customers from certain payment methods or to require prepayment without providing reasons. The products delivered to the customer remain the property of "Renée Imesch – Wildkrautzauber" until full payment has been made.
10. Disclaimer on Plant Identification and Foraging
Participation in my wild herb activities is at your own risk. Despite careful knowledge sharing, the clear and accurate identification of wild plants remains solely the responsibility of each participant. It is expressly advised that wild plants should only be foraged, used, or consumed when they can be identified with absolute certainty.
I do not accept any liability for damages, health issues, or misuse resulting from mistaken identification or improper use of wild plants. A respectful and responsible approach to nature, as well as thorough personal verification of plants, is essential.
11. Delivery, Obligation to Inspect, Complaints, and Returns
Deliveries will be made by post with a shipping fee to the address provided by the customer in the order. Invoices will be sent by email. The risk of loss or damage to the goods passes to the customer upon shipment as far as legally permissible.
If delivery is not possible or the customer refuses acceptance, "Renée Imesch – Wildkrautzauber" may terminate the contract after notifying the customer by email and setting an appropriate deadline and charge the customer for any associated costs.
The customer is required to inspect the goods immediately upon receipt and to report any defects for which "Renée Imesch – Wildkrautzauber" provides a warranty in writing by email.
Returns to "Renée Imesch – Wildkrautzauber" are at the customer's expense and risk. The customer must return the goods in their original packaging, complete with all accessories, and include the invoice and a detailed description of the defects.
12. Right of Withdrawal
The customer is granted a right of withdrawal within 10 calendar days after receipt of the goods.
The deadline is met if the customer sends a written withdrawal by email to in@wildkrautzauber.ch within the period. Exercising the right of withdrawal results in the reversal of the contract. The customer must return the goods within 10 calendar days, in their original packaging, together with the invoice, to the return address provided by "Renée Imesch – Wildkrautzauber". Returns to "Renée Imesch – Wildkrautzauber" are at the customer's expense and risk. Any payment already made will be refunded within 20 calendar days to the customer, provided "Renée Imesch – Wildkrautzauber" has already received the goods or the customer can provide proof of shipment.
"Renée Imesch – Wildkrautzauber" reserves the right to claim compensation for damages or depreciation due to improper handling and to deduct the loss in value from the already paid purchase price or charge the customer for it.
13. Warranty
"Renée Imesch – Wildkrautzauber" strives to deliver goods of perfect quality. It is at the discretion of "Renée Imesch – Wildkrautzauber" to provide the warranty by either offering an equivalent replacement or refunding the purchase price. Further claims are excluded.
The warranty does not cover natural variations, normal wear and tear, or damage caused by improper handling or external factors such as weather.
14. Liability
"Renée Imesch – Wildkrautzauber" excludes any liability, regardless of its legal basis, as well as claims for damages against "Renée Imesch – Wildkrautzauber" and any assistants or agents. "Renée Imesch – Wildkrautzauber" is especially not liable for indirect damages, consequential damages, lost profit or other personal, material or pure financial losses of the customer.
A further mandatory statutory liability for example in the case of gross negligence or unlawful intent remains reserved.
"Renée Imesch – Wildkrautzauber" is not liable for damages caused by partners such as delayed delivery by shipping service providers or other third parties.
15. Other Provisions
"Renée Imesch – Wildkrautzauber" expressly reserves the right to amend these GTC at any time and implement them without notice.
In case of disputes only Swiss substantive law shall apply excluding conflict-of-law rules. The UN Sales Convention (CISG) is explicitly excluded.
The court of jurisdiction is the district of Küssnacht unless mandatory legal jurisdictions apply.
